Construction in regulated area

sir,

i am in problem with my own plot kindly help me please.

1. i am having one plot near god siva temple,which is coming under the archaeological dept regulated area (the distance map taken from google map to find the 100mtrs or above)

2. my plot distance starting from the siva temple 101 mtrs and the end with the 140mtrs.

3. now i am planing to construct a flat nearly 5 houses in that place

4. but the local area people and flat promoter's are informed that the NOC is not available from the archaeological department.

5. If the NOC is difficult to get from the above said dept, can we demand the guideline value for my plot area as per the Tamilnadu government rate.

6. either they have to give the approval to construct a house or flat if they not interested let them give the money as compensation for the place.

If they refuse to issue NOC, you are advised to file a writ petition before High Court, you can proceed your construction as per the guidance of the Hon'ble court.

You have no preferential right over the construction rather a due approval is required to be obtained.
