Criminal suit and civil suit

Querist : Anonymous (Querist) 15 September 2011 This query is : Resolved
Hi, please need advice.

This is the other way round for me. I know that having a civil suit is no bar to file for criminal proceedings BUT can you file a civil suit after you have filed for criminal proceedings??

The supreme court had many time clarified that, civil cases are conducted as per CPC, criminal cases are conducted as per CRPC.

Every/Many criminal case will have some amount of civil action.

You can not link both the things. Each court will decide independently.

When priority comes between criminal vs civil, the Supreme Court held, criminal case should be given priority, because civil case will drag for many years, but, the criminal case ought to be completed before ever body forgets about the case.,
