Hi all,

If wife sys that husband is earning 30000 Thirty Thousand p/m. but she does not have any proof to show in the court.

What is the new minimum maintinance critaria for wife if she has a daughter of 1.5 years with her and Husband is persuing LLB and preparing for CIVIL SERVICE(have all the documents)

I want to know what is the procedure if husband do not pay the maintinance to wife. After the order of maintinance.

Suppose Judge ordered for 1500/pm. and husband not pay the same. then what can be happened to the husband (He does not have his own property).

In the given facts, he should be ready to go to jail for one month against default of one month. This means one month jail against one month default.

Suppose he paid 700-800 and sys that once he will complete his LLB this year. He will pay the amount. Then?

court can not consider such illogical argument/offer. further wife can file a complaint under domestic violance act for recovery of her maintenance. she also can file R.D. application.

why u dont want to pay maintenance to ur wife and for ur child? Is divorce petition filed by any of u? Is ur wife supposed to maintain herself and 1.5 yr old child single handedly? or with ur 700/800 amount?

She hal already filled a complaint under 498A and 325(through modified MLR) in 2009. I stil want to be with her. I had filed a petition U/S 9 in the court but 1 of the midiator called me at that time and said that withdraw the petition and take her through PANCHAYAT. Then I widrewed me petition and she filled 125 petition in the court. 25th was my date. Judge asked me that y we do not want to live togeather. I told the same to him and he took our counselling and said my wife to think one more time that If she want to live with me. And gave us date 20 march.

I am a law student and preparing for CIVIL SERVICES. I showed the documents to the Judge.

I have no other source if income.
