hi,
my wife filled false 498a dv attempt to murder three forced abortion etc in police station . but the officer was not convinced with so much lie(or may be i was lucky) so her complaint ended up in B summary report.she went to her parents house i immediately filled for rcr can any body advice me what to do next.i dont want her back in my life

If you don't want her back in your life why did you file for an RCR? You should have filed for divorce on the ground of cruelty..

In such matters always speak in right direcion and do in the wrong direction, if you want to get rid of such wife because law is in favour of woman, you know. so wait the outcome of rcr and after one year of passing a decree, you may file a petition seeking divorce. If you withdraw your present petition and file for divorce on the basis of allegations leveled by her before police then also this is a good ground proving her cruelty towards you.

I agree with the members. But Hindu law is simply mind boggling, our custom is very simple and we like it, but RCR, JS, period of hybernition of the marriage for one year whether one like it or not..ooops so staggering and tiresome.

thanx for the advice Mr makkadji. i wanted to file divorce immediately but my lawyer told me to file for rcr.v had 2 sessions of counselling were she told the counsellor that she wants seperate accomodation which i refused.for this she is going to file a case against me and when the date came she brought a hand written letter informing the judge for adjournment which was rejected.can any body tell me whats her intention now. seperate accomodation is not a problem but how can i trust her when she backstabbed me . and took away my 2 months old son and used him as tool to blackmail me.

can any learned member reply to my queries.
1) How can wife prove mental cruelty in front of judge, here i mean that she can just say that hubby slapped her, hubby's brother kicked her, hubby's parents gave badwords even if there is no truth in it nor any recorded audio or video evidence nor any witness.Will the judge believe her story, as she can say any damn thing to frame me and my fly members
2) if after rcr wife is willing to join what conditions can the husband put to safegaurd himself and his family member. if they have already and almost have been victims of 498a and dv etc.how do the judges view these conditions moved by husband.will these conditions put negative impression on judges about the husband (in my case all false complaint pertaining to 498a dv attempt murder etc were Quashed in police station and it ended up in B summary report ie case is false and the complainant can pursue futher with judicial enquiry. something like this)my rcr is going on in family court ,this is the worst phase of my life and first encounter with court and police station.scared deppresed mental agony so kind hearted guys n gals please throw some light on my queries.
