Cruelty notice

(Querist) 30 July 2016 This query is : Resolved 
My brother's wife is not coming back to stay with him inspite of several phone calls, messages and a personal visit. The reasons given are useless and not convincing. She and her family are extremely rude and inconsiderate. Please let me know if we can issue a cruelty Notice and if this will help us dissolve the marriage?

Why not, but all depends upon how you would like to prove, if the matter goes to court.

You are contemplating litigation.


It shall be certainly better to try to resolve amicably. For which other party's view should also be taken into account.



If litigation is unavoidable, it shall be appropriate to generate irrefutable evidence and build record.

You need to send notice for restitution of conjugal right through local lawyer.

Try to have amicable solution, take help of near relatives, common friends, effective people of society.

Any legal action / notice from your side would open chain of reaction, they may file no. of criminal / other cases against your brother and others. This may ruin peace of life and would drag in litigation for years.
