daughter's equal share

(Querist) 21 November 2008 This query is : Resolved 
My grand father had 4 sons and 5 daughters. The partition decree of 1952 with his elder brother mentions only 3 sons because 4th son was born in 1954. All properties are ancestral.
My grand father died in 1962. All daughters married before 1977.my grand mother also died in 2000.
All properties are sold out or partitioned before 2000, except one agricultural land of 20 acres.
My mother got equal share in father’s share i.e.,1/50 in sold out properties (1/10 in 1/5).
Now my question is whether she will get 1/9 share i.e, 2.22 acres, after Hindu succession act (amendment) 2005.in remaining un- partitioned 20 acres. Please clarify.(equal to son)

The remaining property will be shared equally amoung sons and daughters.So your mother will get 2.22 acres.

with reference too your query if the partition has not been taken place on or before oct 2004 then your mother is eligible for share.
