my father got accident and death by rash driving of biker. when he was crossing road biker hit him and ran-out from there. he got highly head injury and dead in hospital. kindly suggest me that what IPC section will apply on this case??. plz reply anyone.

It shall be appropriate to consult a very able counsel and lodge FIR, obtain certified copy of FIR, admission/discharge summary from hospital, death certificate, file claim...........
Police may extract CCTV footage of accident and that shall help you.
Your counsel shall advise you on sections and help you , properly.

Rash and Negligent driving case comes under Section 304 A IPC. Regarding lodging of FIR. death certificate. Discharge summary copies with the police you go be Kumar Doeb's advise. The culprit would be booked under Motor Vehicles Accident Tribunal.

Generally, immediately after the incident, one would file police complaint and FIR. Have you done this or not? It is for the police to decide the IPC Section as per the facts recorded in FIR. You can engage a local advocate for insurance claim etc.

This is a Hit n run case.. the FIR shall be lodged against the unknown person currently for hit and run and causing death by negligence. If police refuse to file FIR or take cognizance, then you can file a private complaint in the court.
