Declaration suit

(Querist) 08 February 2012 This query is : Resolved
Hi, Firstly let me inform you all that the case that was pending with High Court for judgement on "Cancellation of Gift Deed" has been won by us. High Court has directed the Registrar to correct the registration documents and so was a tight slap on the opponents in doing this cheap act.

Now the issue is, they (opponents) are under process of filing a Declaration Suit (claiming as owner of the property). How efficient will be their case in front of the judgement of High Court which is in our favour completely.

How should we go about? And I also want to ask is there is any law of stopping these miscreants for filing unnecessary cases on us?

Kindly advise.

if the judgement of high court is in your favour then suit filed for declaratory reliefs will fail .
you show draw attention of the court to judgement filed by high court .

Without seeing the high court order and the plaint of the suit it is difficult to advise.

Thank you Mr. Sethi, we shall surely do so. We are waiting for High Court's order copy. But meanwhile our advocate has filed Caveat to protect our rights.

Thank you once again.

after reading the judgement of the High Court, opinion could be formed. If you post contents here, i shall guide you.
