(Querist) 12 January 2013 This query is : Resolved
Can anyone please tell me what is the difference between Injunction Order and Stay Order?

academic query...consult law book.
Namrata K Mirchandani (Querist) 12 January 2013
I am not from Law background, therefore going thru a law book, won't be as helpful, I want to know how can I restrict someone entering my premises based on fraudulent Deed.. Injunction application has already been filed 4 months ago in cooperative court, to which no relief has been granted so far.. Therefore want to know should I go for obtaining a stay order or ask for Injunction order in Cooperative?

If don't have law background, instead of posting an academic query without any background, you would have come forward with the actual problem, you actually face.

If the deed you say fraudulent is registered
then you need to file a civil suit for its' cancellation which lies only in civil court,as no co-operative court has jurisdiction to cancel any deed.In addition, unless your opponent is also member of the same society, any litigation with him before co-operative court is a futile effort.
As regards to two terms,by an injunction court orders defendant either to do an act or not to do an act while by passing stay order court stops effect of operation of an order passed by its' subordinate court.
