hi,if the prosecution witness has made contradictory statment then pls dont ask further questions on that while u r taking cross coz contradiction in his own statment proved that he does't know the fact or u can say that the witness has become hostile. it is the pluse point for the defence side.

in my view the statement is not contradictory so fas as if the witness once say that i am the neighbour of the accused and later in his cheif examination he say that he seen the accused first time on the day of incident the reason is that may be on the day of incident he become the neighbour of the accused , thus in my view a question for cross examination is : - from how many days/months/years you(the witness) is the neighbour of the accused ? is sufficient to prove his contradictory statemnet else there is a loop which i told earlier also

There is a point in the opinion of Pandey but in general if any contradiction has came in the statement of any prosecution witness, it is in the interest of defense. Why to give a chance to be declared him as a hostile witness rather defense witness should pick up the same line and should go on asking from him whether he had made any statement to the police or not or if yes then what was it? Move in the same line.
