This query is : Resolved
I have filed a case in District Consumer Forum in Thane against Builder & Coop.Hsng.Soc. for not transfering flat in my name. Bothe the O.Ps. have seperately filed their replies to which I have also filed rejoinders individually. The matter is adjourned to Jan.14th,20010. What is the next step as Complainant to be taken from my side. Am I required to file written arguements or any other thing in that matter? Please guide me and oblige.-Mr.Boda.

You have to file an affidavit in support of your claim. OP's shall have to do the same. thereafter you can file written arg. Most of Consumer Forums prefer written arg.

Most of the procedings in Consumer Forum are similar to civil case procedings.

After the filing of version by OP and your rejoinder, now the case will come to hearing. Now you have to file your evidence on affidavit, which you have written in your complaint petition but nothing new can be added to it.Then the OP has to file their evidence on affidavit. Then the matter will be heard on argument and aftr closer of your argument you can file one written note of argument thereby giving case laws in your favour.Regards Silabhadra Sastry,Advocate,Bhubaneswar.Odisha.

After observing minutely the written statement filed by both OPs, you shall have to compare it with your complaint and if any document is required more than already filed, obtain them and file so that you may argue on each point effectively with the help of those documents. Affidavit is also a part of your evidence.

I am thankful to all experts for promptly guiding me in the matter at District Consumer Court and suggesting me to file evidence on affidavit and also giving me number of other suggestions also. However, I will be highly obliged, if some one can provide me a sample draft of such evidence on affidavit on my email id kanaksinh.boda@gmail.com and oblige. I hope I am not asking for too much, but I am new in this field and hence it is necessary. Many many thanks again.-Mr.Boda.
