Division of property among the wives and their sons and daughters

(Querist) 28 February 2013 This query is : Resolved 
One of my friend's father was expired on 09.12.2012.The deceased has three wives.First wife died 40 years before.Decease first wife has one son who is married and he has two sons.

Second wife is alive .She has two sons and one daughter.All of them married.and they have childres.

Third wife is a sister of second wife.She is also alive and no issues (No children)

The deceased was neither written a agreement nor will on the property. Deceased property belongs to self acquired property.

How the deceased prpoerty devlove among the family members.What is their proportion.
My friend is a second wife's son.
What share he will get among the family members from the deceased property?

how can ahindu have 3 wives?


father property will be inherited by the children .

1st wife
1son

2nd wife
3 children

3rd wife no children .

it will be divided equally among 4 children . 2 nd and 3rd wife wont have share . i presume father married again when the first wife was alive

Deceased was married after the demise of First wife.

If the deceased had performed his second marriage after demise of his first wife then the son of first wife, second wife and all 3 children born out of this second marriage shall have equal right in the enitre property.

Tis means 5 equal shares in favour of rist son, second wife and her 3 children.

Nothing for third wife as this marriage is void in the eyes of law.

This opinion is based on assuming that the family is Hindu.
