My client's husband filed a divorce case under special Marriage Act. the case is pending. My question is shall I file a case under Domestic violence Act? She left her matrimonial home 3 years ago. Shall I file a case under Domestic Violence Act now?

It will take time for decision of Divorce matter. If you need any urgent relief under DV Act, you can file proceeding under that Act. The two Acts operate in different fields. Hence there is no bar for filing proceeding under DV Act.

As advised by ld. experts you can file DV act complaint. These two are different remedy for diff. persons you can file it at any time.

You can file a case under DV Act and there is no bar
