I visited a private multi-speciality hospital, for my dental treatment..During consulting with dental surgeon,I made my intention clear for restoring/rehabilitation of decayed multiple tooth by implants ,without extractions..To this, the surgeon after examining Xrays & CT scans of my mouth, assured me,but orally, that only one or two lower tooth will be extracted.,On this faith & assurance I paid agreed consideration in full in advance to hospital. But later, contrary to commitments/claims my all seven teeths were extracted of front lower arc without patient's consent/knowledge & one tooth was removed unrelated to treatment.
The surgeon however got my signed general consent on printed proforma.
I have ,however, written to hospital, above mentioned facts & requested to refund my entire cost of treatment,as I don't wish to continue the treatment & further asked hospital to furnish me with all the related case history, treatment details etc but hospital has not replied my written request.
In this context, please guide me grounds if any with me in this case, moving to Distt consumer Forum against hospital
Is Consent proforma obtained by hospital means consent given by patient for its un-hindrance treatment by all & every means?
At the time visiting hospital,I was under impression that hospital's Dental dept.is wholly owned by hospital but later come to know that dental dept/wing has been functioning under PPP arrangement with hospital by separate entity
Please guide me how to hook such unscrupulous service providers.

You have an idea what and how consumer complaint should be pursued. The letters written by you and NO REPLY by hospital is a matter on record now.
The PPP arrangement is probably ‘Public Private Partnership’. Such arrangement is made by Govt. entities.
Whatever is the arrangement the hospital has to inform you and provide copies of all docs including general consent form signed by you.
The doctor has to explain the treatment and obtain your consent.
The tooth was not extracted in OT under some life threatening conditions/under general anesthesia that it was not possible to inform the patient/attendant before extracting/removing an organ/limb etc……………
The doctor is responsible even if it was under PPP.
Approach an able and experienced lawyer dealing in consumer cases with all record that you have and proceed under expert advice of your lawyer after you have understood the merits and remedies.
