hi,
Me and My husband are seprated from last 3 years, because he and his family used to beat me, Now i want to file a case against him for Domestic violence/Dowry etc, please suggest wether i can do the same right now or not , we have done that earlier also at my native place but later we stop it by producing an application that we are trying to resolve the matter with help of relatives, but all in vain, nothing have happened yet since Apr 8, 2006.
Could anybody please help in the same

Hi Shalini,
It is highly commendable of you that you went in for talks even though it is 3 years since you separated, and have tried to get back to your husband.
You can file a case any time, there is no time limit as in civil cases. You can file for divorce on the grounds of cruelty. Am doubtful if you can take up the reason of beating since it is 3 years since you separated and there is no beating since 3 years. This is as far as am aware. Have you filed any complaints before the police, during those days?
You can file a dowry case only if they harrassed you for dowry. Only beating without dowry demand does not amount to dowry harrassment.

no, we are trying the same from last 3 years as my family is against Divorce, but nothing has happened yet, 3 year back in july 2006 we filed a case but asked to stop when they were ready to talk on same but nothing has happened yet.
but after 3 year now i got success in convincing my parents for divorce and now I dont want to tae risk i want play a safe game, so i am asking all these questions.
