Respected Members Of The Forum
Pl. enlighten me on the issue of “Effective Hearing" as I was observing the proceedings in the Fast Track Court. One senior Advocate submitted the application of adjournment for the appeal n Hon'ble District n session's Judge has refused to give adjournment and controversies hv started. Any authority for this “What is Effective Hearing?" I m asking this just for my knowledge sir please explain and appreciate this. thnks

Sometimes adjournments are sought with some ulterior motive. The fast track courts are established for quick disposal. You know that justice delayed is justice denied. Hence, the fast track courts are supposed to be slow in granting adjournments. I have not come across of any authority on Effective Hearing contemplated in Fast Track Courts. But effective hearing means the stage of actual hearing of the matter. It conveys that the matter shall be positively heard. Some matters that are comparatively new are posted for formal hearing.

Effective Hearing means, to include only the actual or remarkable points by avoiding unwanted elabrations or explanations.
