About false case

(Querist) 29 September 2011 This query is : Resolved
In an Office Charge Memo was issued to a Revenue Inspector for less collection of Revenue. The charge Memo was obtained by a layman who has grudge against the Revenue Inspector, put a petition to the ACB Department. The ACB Department called upon the Head of the Office and obtained a statement wherein the HOD accepted due to the attitude of the Revenue Inspector there was some loss. But as per records there was no willfull loss made by the Revenue Inspector,to the department. With out going through the records and basing on the statement of the HOD, the ACB Dept is trying to register a case. What is the remedy to the Revenue Inspector?

No remedy, except to defend the case strongly and stress upon the ACB to prove the charge. ACB cannot win, merely on suspicion and presumption basis. The need to prove is NOT the shortfall in revenue BUT that of the instance of any fraudulent activity or corrupt practices on the part of the revenue inspector.
