Respected Sir,
My father Late Sri S Yesuyohan was an Railway employee as Pman/SS/O/TNGL. PPO No 27054100944 and he was expired while he was in service on 25.04.2005, leaving behind him, my mother Smt S Jayamma and my brother Sri S Harish and Myself as his legal heirs and i further state that my mother was taken family pension of my deceased father till her death and my mother also expired on 31.10.2006, leaving behind her, myself and my bother. After the death of my mother, i have taken the pension till i attained 25years age. I.e upto May 2008.
From June 2008 the Railway Department has stopped the payment of my pension. After enquiry with the railway DPO, he informed that the format has been changed and asked me to Re-Submit the documents to process Family Pension to Un-married Daughter Beyond the age of 25 years, As per given check list, and as per instructed I submitted all the documents to railway department, Hubli Personal Department on 21.08.2010.
On 03.06.2010 I got married to Mr. V Paul Varma resident of Chintalpally ‘V’, Manjeera Barrage “Po’, Sangareddy “Mdl’, Telangana 502294. After Marriage I submitted all the required documents to the Railway Department on 21.08.2010. Whenever the department made Queries/Remarks, I submitted all the necessary documents to speed up my file to get the disbursement of my pension arrears settlement till the time I got marriage (I.e June 2008 – May 2010). Under the scheme Family Pension To Un-Married Daughter Beyond the age of 25Years.
My Case is pending in the Department from 7years (Seven Years).
Need your Guidance for followings.
Received a letter on 13.08.2015, to submit pending documents to processed the file, 1) Survival Certificate issued by Revenue Authority.
In a confusion i replay with LIFE Certificate issued by sangareddy Tashidar, to the railway department, but they required Legal heir certificate instead of life certificate.
My brother got job under compassionate in the year 2007 and working in Hospet, he applied 4 times for legal heir unfortunate got reject, as i did not produce local id proofs.
i applied in MRO sangareddy and got the certificate based on the FCC (Railway Department), Attested Death Certificate by advocate, local ID proofs.
I submitted the document on 06/09/2017 to railway inward section, after frequent follow up now they are asking LEGAL HEIR certificate of Hospet MRO not the sangareddy MRO.
As i applied for Pension Claim for unsettlement / arrears from June 2008 – May 2010. i dont know why they are asking the Legal Heir certificate when we Produce FCC and PPO. and iam not asking for Extension of Pension but for the settlement.
Sir Pls Guide me in this matter.

At the time of applying the legal heir certificate, where did you live? In Hospet or Sangareddy? if in Hospect you have to take certificate of the Tahsildar, Hospet. so you have to apply to the Tahsildar, Hospet with necessary copy of all certificates. and make an application to the higher authorities of the rly dept. under RTI Act. then you will get proper reply.

I was in sangareddy At the time of applying the legal heir certificate, and i got the certificate from sangareddy on 02.09.2017, based on sangareddy id proofs and raily way FCC. now the railway department asking me to submit hospet legal heir certificate, as the sangareddy certificate will not accept.

Better you consult legal expert dealing with service matters in CAT for legal position on asking the legal heir certificate when you have been receiving the same up to a point of time as unmarried daughter. I am of the view Railways can continue to admit your pension until you got married based on life certificate which required to be submitted by any pensioner once in a year.

all that could be understood is that
1. the pension died.
2. his wife died
3. his daughter is 25(+) and married
Is it correct.

i applied for Pension Claim for unsettlement / arrears from June 2008 – May 2010,
in this matter does Railway union will do anything, or shall i meet any higher officials,

you are running after a futile battle.
what railway union will do can be asked from them only as this forum cannot be their spokesperson.
The case is also time barred for going to court.
