hi,
My friend is a goldsmith.
one day his friend came with a 'mangal sutra'
he said to my friend ke ye sona gila ke do...

n my frnd has done that..

he did not had any idea that that mangal sutra was of chori...

and police has come to his office and took my friend ...

police has asked him to deposit the gold back

because my friend is from a reputed family he has deposited the demanded gold which was much more higher than the actual mangal sutra.

now what should he do if again some case comes in his name ??

what kind of charges are applicable on him??

he has not gone in any court till now.
nor he received any summons.

if he found guilty than what kind of punishment can be given to him ???

and is there any way out ??

he was there in lockup for two nights .. and now his family dont want him to stay in lock up for even a day.

has your statement been recorded yet . in your statement please mention that you have known your friend for so many years . when he came to sell mangal sutra you were informed that it belonged to him and in good faith you have melted gold . you were not aware that it was stolen mangal sutra . in addition you say that when you were informed by cops you immeditedly returned gold back .
beofre filing case statement will be recorded . as no staement recorded you are unnecessarily panicking .
it is only after case is filed aginst you will any summons be served .

It seems the police has caught the real thief and on his identification the gold has been recovered. However if there is no threat to your friend from police regarding arrest , there is no problem but police must have made your friend a witness in that case against the thief for which summons may be served to him. He should get his witness recorded if summoned by the court at proper times. It is possible that police can include name of your friend in the theft case but from your versions it does not seems so

I second the advice of Dr. Anil.

when facts are not narrated correctly nothing more can be done, based on limited facts anticipation of Dr Anil Kumar Singh may be correct. But i anticipate your friend bought the article and then converted it in raw gold
before police could lay hands on your friend
and asking so much of raw gold(less or more in weight)by police means it has shown recovery, but it is not clear from your statement from whose custody, from thief or from your friend?

yes ,
his statement has been taken by 1st police.

then 2nd time another inspector of another police station took my friend for the same case, but now inspector says that he has arrested some guys who took my friend's name as in that my frnd has melted the jewels and sold the same.

if he even go for legal suit lawyers are advising him not to do so..and says that police aapko diffrent charges lagayegi and pareshan karegi...

now what to do ???
