Dear Mr. Krish,
You are in Delhi. You have opened seven different threads where you have posted queries in bits and pieces.
You have a real and running problem with your brother's family in respect of the property after the demise of your father, mother and your elder brother. It also seems that one portion (one half of second floor and third floor) of the property was also unauthorisedly constructed.
While you may get the answers based on legal provision, how far they would become useful in a practicual situation with so many inter-linked issues is anybody's guess.
I would sincerely advise you to approach a Delhi Lawyer to get his services to attend to your problems. Since simply trying to know the answers without effective action would prove costly in the long run. To put it mildly, your losing precious time, by not consulting a local lawyer in your place.

I completely agree with the experienced and precious advice of Ramachandran. Don't waste time and energy of experts unnecessarily if your background is similar as told.

You should file a suit for partition of property and seek interim relief as deemed fit and proper in the circumstances. No criminal charge in the facts stated by you can be held against your brother.
I am not aware of your earlier queries but certainly some disputes require engaging of counsels for effective settlement. An advice on this forum can suggest you the course of action available to you but it shall be difficult for you to take recourse to that remedy without the help of lawyers.
