Selective discrimination by consumer courts

(Querist) 20 February 2012 This query is : Resolved
what options are available for a victimized consumer where a bank manipulates from two of its group companies dealing in insurance when covenanted specific policy is not booked from the company having the product but books with company which does not have the specific insurance and cancels the proposal without issuing any policy after five months?

Also, application form for alleged insurance is fabricated and forged in the name of a non-existent "loan co-applicant" which the consumer courts have ignored despite being strongly contested and relied strongly upon to dismiss the complaint & appeals by wrongly dwelling on a co-applicant for insurance amounting to twisting of facts in a wrong manner and against principles of justice.

if consumer forum has erred in its judgment then you have a right to appeal.

simultaneously you may make a complaint with RBI and IRDA for penal actions against the said financial organisation for the bungling done by it.

Thank you Mr. Kiran Kumar for responding.

IRDA has not responded and I have strong reservations if RBI is any better.

Is there any legal remedy if the national commission is also apathetic by simply throwing away the file and mechanically agreeing with state commission?
mahendrakumar (Expert) 21 February 2012
how can you presume that NCDRC also will not ,attend your appeal promptly?

you can appeal to SC,then?

simultanously, you can use rti for the follow up at IRDA and RBI.

all these will take some time.

if the amount in question is worth, try.

You can approach the national commission if not satisfied with the decision of state commission and then the Supre Court as per the hierarchy.

If you feel that you have all the grounds on your side, you dan definitely approach the national commission and if you succeed in presenting your case effectively, then the case can be in your favour.
