Non payment of rent

(Querist) 25 March 2012 This query is : Resolved 
suit filed for non payment of rent is fixed for consideration and assessment of rent. i being plaintiff having rent agreement stating amt. of rent and bank statement showing monthly credits of rent paid by tenant before he committed dafault. bank statement is computer generated statement and does not require sign of bank official. will this be sufficient to prove rent default or court will ask tenant to prove that he has paid rent

Dear Kamal,

You should have mentioned some contents of the rental agreement.Bank statement showing monthly rental credits is valid,but if you have to produce it legally as evidence,obtain an official statement duly signed by the concerned officer of the bank.Since how long has he been a defaulter.What was written in the agreement,if the tenant defaults too pay the rent?
These are all technical points,which have to be highlighted.

Court will give an opportunity to the tenant to show that he is not a defaulter.

you must be having rent agreement duly signed by defendant mentioning amount of rent payable by defendant .

as far as bank staement is concerned it has to be signed by officer of bank .


what is the stand of defendant ?

has he filed any reply?

your lawyer will advise you and take appropriate steps .

Court will allow tenant to prove that he is not defaulter in paying rent.You must file
S/a/c of bank certified as per bankers Book of evidence Act in court.

Get the computer generated statement proved by calling an official with record from the concerned bank.
