(Querist) 27 March 2012 This query is : Resolved 
Sir,

Defendant's IA along with the docs. to receive documents allowed inspite of my objection. During the Inspection in court office I found that defendant instead of submitting original Sale Deed as mentioned in the said IA has enclosed certified copy of the Sale Deed obtained from concerned Sub. Registrar. Now he intend to get the said CC of Sale Deed marked(Exb.) in his evidence. Can I raise any objection. How? pls advice.

In case the original sale-deed is lost then such party should pray before the court to lead secondary evidence which may be certified copy obtained from the office of registrar and may be got compared with the record of the registrar but without obtaining permission from the concerned court, such evidence cannot be led and cannot be thus exhibited.

Yes, by filing application u/s 151 of CPC

in court.
