Claim for property

(Querist) 01 May 2012 This query is : Resolved
hi
my maternal grandfather passed away a couple of years back, without making any will. Now my maternal grandmother and my uncle (my mother's brother)stay in that property. My mother has also passed away. now do i hold any legal right to claim stakes/ share in that property? Also my maternal grandfather is got half a portion of the property from his father through a will and the other half is with his father, and they stay in the same property but the property is divided into 2 portions i.e front portion and back portion whereas the front portion belongs to my grandfather.
Now my grandfather is succeeded by his wife who is alive, his son who is the youngest, and three daughters of whom my mother was the eldest. Now, at this point of time I would like to claim a part of the property , i will also have mu aunts as the co applicant in the claim. We want, either the property be sold off and equal shares given to all or a floor be given to each of the heirs.
what is the legal way to go about it and can we actually raise any such claims????

Yes you can claim the property of the share belonging to your deceased mother.

An amicable deed of partition is preferred.
If that does not happen then file a suit for partition and injunction so you are not deprived of your share till the suit is finally disposed of.

I endorse the views for amicable settlement,

though your right can not be defeated.
