Rights of daughter in property

(Querist) 12 June 2012 This query is : Resolved
We are one sister and three brothers. When I was five and my elder brother was three we were sent to our maternal and paternal houses respectively. The other two brothers lived with my parents. Now we are all married and settled and our father is alive. Now he has gifted(danpatra)all the property(ancestral+his own) to the other two brothers.Me and my elder brother are not given any share. Actually the thing is that I stay outside India and therefore can't contact any lawyer. My grandfather's house was transferred to my father's name by my grandfather. My father has ten sisters so the other lands owned by my grandfater were taken over by my father.Neither did his all sisters sign the paper saying that they have no claim on the lands nor did he do this infront of a register or notary public. Now is this called "ancestral".What are our shares in this and how are we supposed to get this? How will we get a share in it?

Since the grandfather's property was transferred to your father by your grandfather itself it is not ancestral property and your father has absolute rights to act as per his own sweet will which cannot be challenged by you.

yes, its self earned property so could not disturb any one.

i do agreed with the experts the title already been transferred with willful from grand father to ur father then it means it is his property and he can gift to any one. y he acted such those way. why he shown his bitterness on you and ur brother

If it is the self acquired property of grandfather - and it was gifted/sold/will(ed) away to your father (without a specific condition that reflects his intention that property is to be held for the entire family including children. Claim cannot be laid to the property, and father is free to dispose it off

That means the father can do anything he wants and even our law cannot stop him.Is this the justice in India?

Yes. father can do anything.
