Case transfer

Hi,



My divorcee case is going on in subcourt and maintanence has been filed too. But i wish to transfer the case to family court within city limit as i live in city. currently the case is going on in district subcourt, Whats the procedure to transfer to family court , how much it cost and how long will it take to transfer. As of now nothing has been fianliesd in subcourt inspite of long years ....tks

Generally Family Courts have been established in almost all Districts but still there are some left. Wherein the family courts are working, such cases are solely dealt by them but wherein the Family Courts are not working, such cases are being dealt by District judges or additional District Judges.

There shall not be any charge involved if the case has to get transferred from any other court to family court as this is the routine process.

For transfer you have apply in the High Court.
If you are a housewife and finding it difficult to attend the case in sub court then the cases is likely to be transferred.

For inter district transfer you would need to go to High Court and for inter state transfer you would need to go to Supreme court.About Cost or time can it is hard to speak correctly.

Decide the possibility first.
Are you Wife, and residing away from present court, you can get trf to your nearest court where you reside.

yes rightly advice women have problem to attend the court and it is better for them to make transfer application and it will move immediately and reason should be strong as you cannot travel or you are alone or your children are alone and no one are there to take care of them
