First and foremost you have to indicate whether the property was the self-acquired property of your grand father.

If it is the self-acquired property of your grand father, then he can dispose of the same in whichever way that he wants and nobody can complain against it. (If it is his self acquired property, and if your grand father wants to exclude your mother from the benefit, he is legally within his rights, and your mother has no legal claim or right and she cannot complain against his actions.)

I agree with anirudh.

If it is ancestral property in the hands of your grandfather, then you can claim equally along with your brothers and grandfather even now. No need to wait till the death of your grand fahter. Your grandfather cannot write a will relating to whole property. He can write a will upto the extent of his share.
