Pension & gratuity

(Querist) 21 June 2015 This query is : Resolved
Sir,
My father is having 25 years of continuous service in central government and is due to retire in 2018. Due to personal reasons he wants to resign the job now. Will he be eligible to pension and gratuity benefits.?
Guest (Expert) 21 June 2015
He can apply for voluntary retirement, if 25 years of service is completed. He can get benefit of 30 years of qualifying service for the purpose of calculation of pension.

Consult local service law expert in central govt. service cases and show him all the documents.

There is no point of law involved and no need to consult any lawyer. issue is plain and simple.

I will agree with Mr Dhingra and will add that for the purpose of pension 25 years of service means a regular and paid service. The period of ad-hoc service and other non-qualifying (unpaid period if any) will be excluded.

It is not merely service rather"qualifying service" for 20 years which makes one eligible for minimum pension.

Notwithstanding the above even if pension is due one will not get it in case of resignation. Pension is paid only in case of retirement (including VR)

please come clear with the facts for better advise.

How the doubt is coming to his mind even after being in service for 25 years.

Your father will be entitled for pension if he opts for voluntary retirement. pension would be @ 50% of the basic pay last drawn plus DA and medical allowance. So also, he will be entitled for gratuity for the qualifying service rendered. He can also commute upto 40% of the Pension.
