Tenant Trouble

Querist : Anonymous (Querist) 24 January 2010 This query is : Resolved
My tenant is illegally occupying my flat inspite of termination of tenancy and a court case which I have filed against them.
Now understanding that the court case would take time, he is asking for Rs. 10Lacs to vacate. Is there any way I can have this proved as blackmail/bribe/illegal on his part.

If you have terminated tenancy and have filed petition seeking eviction on the ground of your personal necessity then you can add the prayer of cost of use which generally can come to more than 3 times of normal cost of use of the adjoining area. Means he will have to pay 3 times normal rent of the similar shop of the area at the time of handing over the possession by way of court process. Time is an essence part of our judicial system but do not bow your head against his illegal demands if you can struggle for some more time.

The proof of asking for money to vacate the tenanted premises shall not have any bearing on the merit of the case.
