Cheating in marriage

My sister got married in 2012. She is having a son of 2.5 years. Her husband concealed the chronic disease of Haemohilia before marrige. This we come to know in 2016 April. The disease is a seriuos one transferable to next generation.And now he told us he is suffering from kidney disease(both completely damaged). This we dont know whether it was prior to marriage or not.
My question
1)Can we file fraud case against family?If so what maximum punishment they will get
2)Can we get the maariage annuled?In this case can my sister get the custody of child?/

Are you really worried about your Sister and her Child Or your intention is to punish your brother in law.Suffering from illness will not be a valid ground for Divorce.Better approach this Issue with Humanity.

If it is true, his both kidney damaged, try to give him courage and peace for his rest of life.

Ans: Punishment can not be predicted, in any case with out referring full case file.
Q: 2)Can we get the maariage annuled?In this case can my sister get the custody of child?
Ans: No annulment at this stage.

Mr. Gupta,
With reference to your description, "Her husband concealed the chronic disease of Haemohilia before marriage" I would like to put a simple question to you, under which law do you consider he would have compelled to issue a declaration about his diseases before marriage.
Another question arises, did you solemnise marriage of your sister without making any verification about the boy?
Further, if you file a fraud case against the family or get marriage annulled, in what way your sister is going to be benefited by those cases?
Frankly speaking, yours does not seem to be a real problem, rather an academic query.
