If the buyer has paid the stamp duty and the seller does not want to sell property because of sudden financial crisis of seller, can buyer refund stamp duty? Or seller is liable to get fined by law?

Stamp duty, if not used, can be claimed back after deduction to the extent of some %age (10% in some states). Amicably settle the deducted amount between purchaser and the seller.

Thanks for the advice.. but I want to know wheather purchaser can take any legal steps against seller and the seller will be fined.
