i'm the owner of land.. i gave only the development rights in respect of that land along with p.o.a. to one person.. that person without my knowledge assigned the development rights to another person and also executed p.o.a in favour that person.. that 3rd person on the basis of very p.o.a. vide Sale Deed purchased land by himself... the very p.o.a. which i have executed didn't contain any rights as to sale purchase of that land.. i have filed complaint u/s. 420, 418, 406.. can process be issued in these circumstances??? how???

Your POA can act strictly within the powers delegated to him by you any act in excess of the powers conferred by you are not binding on you a POA holder can create a sub agent only to further the purposes for which you created an agency appointing him ;In addition to the criminal complaint seek to set aside all actions of your POA which are outside the strict scope of the POA executed by you; for setting in process all actions through due process of law you need a advocate to act on your behalf .If by PROCESS you mean legal action against your agent the answer is YES .Ask any competent advocate locally available to file appropriate suits /petitions under The contract act /The specific relief act /Indian penal code IMPORTANT publish all your intentions IMMEDIATELY in the local news papers
