Hello Sir, Im a Student studying B.com, Im a the youngest son in my family, i have a property on my late fathers name, and the original sale deed and free hold property documents is with my elder brother. Can anyone make any changes in the property by registering on his own name.is it possible, what are the legal way of securing hard earned property of my late father. please help me and suggest me how to take care of the property.

Dear Younus,

Upon the death of your father, the property left behind by him will go by way of inheritance to all his legal heirs viz.,

his wife (if alive) 1/8th share
sons(s) and daughters to get the balance 7/8th share. The each son will get twice the share than what each daughter gets).

Thus, you people have to first make an application to the Tehasildar of your area for grant of legal heir certificate.

On the basis of the legal heir certificate, the property left behind by your father has got to be mutated in all your names.

Dear Sir,

If all the legal heirs are not ready to mutate the property on there names. Can the first party who have the legal original documents can make any nuisance in the property by registering on his own name, is it possible.
