Querist : Anonymous (Querist) 16 November 2010 This query is : Resolved
i have a stop payment on check which was already paid.as the plaintiff has filed a case against me for cheque bounce ,my advocate also cheated me into filing a proof affidivat in the favour of the plaintiff ,the court is not accepting my additional affidivat explaining the same , i have explained the same in court to the judge that the affidavit is fabricated ,what cani do ?
the court is also not considering my proof of having paid a cheque and the plaintiff is a money lender who is influencing my advocate,

If you have got proof of payment then the Magistrate can not ignore your prayer for new affidavit. If it is rejected then go to the higher court challenging the said order.

come clear with your facts first.

if you are unable to explain the technicalities of your case and also not satisfied with the services of your lawyer then you may seek services of some other counsel.

At the same time you can also file a compliant with the State Bar Council about the professional misconduct.

Your query is not clear. You say plaintiff, proof affidavit and cheque bounce case.
Whether you have two cases civil and criminal? Whatever you have said in the civil court, by oath, it will bind you in the criminal case also. If you want to take a different stand, it is very difficult to prove it int he court. Your statements will be become untrustworthy.

I agree with Arun.

Irrespective your contradictions in story as pointed out by others above please do some hard work and find evidence if the complainant is a money lender.

If you can do it file a complaint in the same court for prosecution of the complainant under your state act. This is unusual procedure but if you are persistant there will be instant results.

No use filing complaint against the advocate as many non advocates suggest since they are not conversant with bar council procedures.
