Dear Respected seniors.

Hope doing well.dear sir need your valuable suggestion regarding property matter, fact is as below:

In Bangalore in urban Karnataka govt sites has been gifted to poor people. in that same that site one of my friend’s grandfather was staying since from 42 years in that same govt site, without any legal documents. Like (Hakkupathra) In the same jurisdictional area. Now my question is:

1)How to make a legal documents for that the same property.

2)The same land is built ed very good condition with the paid of khata and revenue tax from last 7 to 8 years.

3)Party is paying all taxes and related fines to concerned authorities without any fail.

1. The rental receipt is the only document for your possession. The allotment letter is also a proof.

2. This is a proof of possession. but, not a proof of ownership.

3. This proofs are enough to establish the possession.


For ownership apply to the District collector, for issuing of patta in your name, by producing relevant documents

Sir actual that remaining waste landstone which was not cleaned and my friend's grandfather only done the clean and everything and he was staying the said place.

Your friend grandfather is paying all the govt. revenue tax so there is no question of his possesion. For getting the ownership apply to DC of your locality with relevent document as advised by Arunagiri sir.

Apply to the District Collector to allot patta as your friend's grand father is staying there and is entitled for rights on the basis of adverse possession. Cleaning/Safe-guarding the land will not give him any right to claim the property. The Government may consider only to the extent of site in which he is living.

If that gentleman was allotted with the land through hakkupatra, then he has a valid title, the very hakkupatra confers the title and to prove possession he has paid taxes to the concerned department on his name, but in case of occupation of government waste land without any title and had been enjoying the same for than 12 years, had been paying taxes on his name, he can apply for khatha and based on that he can even register the land in his name. Take the help of a good local lawyer or a land consultant and proceed accordingly.
