(Querist) 14 November 2014 This query is : Resolved
Hello sir, In partnership firm Should the retired managing partner name be removed from the sub-registrar office document and from patta doc. in revenue records?
Devajyoti Barman (Expert) 14 November 2014
Why the name of the partner is mentioned in patta record?
If the property was purchased in firm's name then patta must not record the partner's name.
Sudhir Kumar, Advocate (Expert) 14 November 2014

Since partnership firm is registered with Registrar of Firms and Societies whereas its assets are registered with Sub-Registrar, two different authorities, accordingly, besides the questions raised by experts hereinabove, I would like to know you want to remove the name of retired partner from partnership firm or its assets?
T. Kalaiselvan, Advocate (Expert) 17 November 2014
If the assets of partnership firm have been registered on the individual partners name, whosoever is retiring from the partnership firm, can execute a registered release deed in favor of the firm or the other partners on whose names the assets have been jointly registered. This way the mutation of revenue records also can be done.

Thanks for your replies sir,First there were a two managing partners so the patta was issued in the name of two managing partners only not in the name of the company.
Later one managing partner retired from the partnership.so,now my question is should the retired managing partner name be removed from the patta doc.
OR is it a mistake of the revenue department to issue a patta in the name of managing partners instead of the firm?
In the Encubrance certificate there are three claimants entry. The first entry is "Name of the Managing partner-1",the second entry is "Name of the Managing partner-2" and third entry is "partners of the firm" generally on whole not mentioning other partners name individually.
Initially There were two managing partners and five other partners totally seven .
The land purchase document was signed by two managing partners then.
Sailesh Kumar Shah (Expert) 17 November 2014
make prayer before revenue authority stating that land purchased by partnership firm through its own fund and remove name of managing partner.
Dr J C Vashista (Expert) 18 November 2014
How does the company come in between when there is nothing on record i.e., capital, land or registration certificate.
Some vital and important link is missing in the facts stated by you.
Show the documents to a local lawyer and seek his opinion, advise and guidance.

The recital of document is important. If the document is in the name of registered partnership firm with a recital that "represented by MP(1) & MP(2), it can be construed that the title is with partnership firm and if one of the Managing Partner retires, the retirement deed will form part of the original partnership deed and the title is protected. If the Managing Partners name appear in the title to the document in their individual capacity, it has to be rectified.
