Family pension

Dear Experts,
My grandfather was a Upper Division Clerk in Customs and Excise Department, after his death my grandmother used to claim pension. Now as per law of pension to unmarried daughters my maternal aunt( who is unmarried) has claimed for the family pension after the death of her parents. The department has admitted that she is eligible to claim pension but the department has lost the service book of my grandfather and so they are not releasing the family pension. There is a letter from Ministry of Finance instructing the subordinate office to immediately release the pension amount still they are not proceeding for the same and stating the reason of loss of service book.
Please guide me about the further course of action.

The authorisation for family pension would have been recorded at the time of snction of pension/family pension.If the details of family memebers had been furnished,you can verify it.Elsu,you can send application through the head off office where he worked/retired for inclusion of your aunt.

The grant of family pension to widowed/ divorced/unmarried daughters is of recent origin after 2007. Naturally, the names of such persons would not be in the PPO. Such requests requires to be processed by the Department on the basis of service records and there is a real problem if service records are not available.
You may pursue the matter by ascertaining the present position under RTI and subsequently approaching the Ministry of Personnel. You also have the option of approaching the Central Administrative Tribunal.
