I resigned without serving the notice period. I took maternity leave of 3 months but wanted extension of 1 month. Extension was not approved so I resigned without serving notice perio as my 2 months old child was not in good health. Company denied relieving letter that time. I have resubmitted the request for relieving letter now. Please advice if I could take any legal action to obtain my relieving document.

it is your right to be an employee or not under Art 21 . so issue a legal notice, if they deny the relieving letter with in 2 weeks you may move liquidated damages on the said company, for causing serious mental stress to you being a lactating mother.
None can treat any employee as a slave. under Art 21 itself r/w Art 14. r/w Art 226 writ jurisdiction of the relevant high court.
