This query is : Resolved
Dear Sir,
I am a Central Govt. employee. I have given an amount of Rs. 5.50 lakhs to one of my close friend for her husband’s wine shop.
1. By taking My Personal hand loan around 2.00 lakhs from State Bank of India.
2. By taking loan from one of my relative around 3.50 lakhs @ interest around 3%.
Since already 4 months over now of my friend is having no intention of giving money neither interest also. I have a lot of pressure from relative for want of money.
3. For 2.00 lakhs amount she has given a letter to bank stating that an amount of Rs.6400/ - may be credited to my salary up to 2019.
4. For 3.50 lakhs I have cheque for Rs. 1.50 lakhs and 2.00 lakhs without name and date.
Can you kindly advice.

Sir,
Better get the cheque presented and ensure that before you get those cheques bounced, create some evidence to make your stand stronger.
Warm Regards

Whether your service conditions allow money lending business to dealers / otherwise?
Can you borrow / lend from / to private sources without official permission?
have you taken and given money through cheques / with proper receipt?
What reason by your colleague mentioned in her letter for effecting credit of Rs. 6400/- to your account?
Please think on all pros and cons and file suit if cheque is bounced.

Sir,
1) As a Govt. employee service conditions will not allow money lending business.
it was purely on friendly basis. and I am not taking any interest for the 2.00 lakhs. She is re-paying the amount for the 2.00 lakhs along with bank interest only.
2) I have given the money through cheque and also cash in some installments.
3) My friend has given a letter to the bank saying 6400/- money may be credited to my account March 2019.
Reasons not mentioned.
4) I have a doubt the cheques are not on my name. If i put it on my name. will that effect my 2.00 lakhs along with interest which she is paying in the bank. She may say that I am already paying in the bank?
5) No name and date mentioned on the cheque given to me.
Will it be a problem if i put it on my name??

Lending and borrowing is prohibited by the govenrment employees, you have made an illegal and unauthorised transaction. Do you seek help/advise of legal experts on this platform regarding ways/manner to legalise/regularise your illegal action?
However, if you have already lended, did you intimate your employer for the transaction?
Did you show the transaction in your ITR?
Did you issue legal notice after dishonour of the cheque?
Consult and engage a local lawyer for proper guidance and proceeding.

Ms Yamuna,
Thanks for the compliments showing your arrogance for one and all members of this site and even your local lawyers also terming them as cheats.
But, as per my judgment, your query is merely an academic query, not a real problem being faced personally by you. So I don't think if the experts or the adminstrator of this site would mind about such type of certificates from students, who try to hoodwink the experts of this site by falsely posing their academic problems for solution posing that to be true personal problems.
Moreover, no instance of cheque bouncing has been quoted in your description, while you have tried to attract attention of the experts by posting your query with the false caption of "CHEQUE BOUNCING." So, your query is quite premature merely based on your supositions, as your doubt about cheques cannot be treated as your legal problem.
So far as your statement is concerned "but before going to local lawyer i wanted to consult and to submit local while browsing internet i got this site," your approach is quite wrong in trying to test the knowledge of the experts just to solve your academic problem. However, if you really had such a problem, you could well have consulted some local lawyer and only thereafter would have approached the experts of this site to get their opinion about your real doubt, had you got some in his advice.
Without approaching any of the local lawyer you have labelled them to be cheats, when you said, "I know many lawyers are cheat."
About your direction to the experts here by saying, "GET LOST," you probably forgot that none of the experts of this site approached you to get solution from them. Only you approached the members of this site. So, think, who deserved to get lost?
But, still, if your description has even a slightest truth and you really are facing any such problem, you may send all the case related papers to me through email for examination and advice. Email ID is: 1962dcg@gmail.com
Best of luck!
