Accident

(Querist) 19 February 2017 This query is : Resolved 
Recently I met with an accident on a single road of a double side road as the other side was closed for past 3-4 months for repair. I was on my side on a speed of 20 kmph . A mother cycle coming from the other side banged into my car and in this process got hurt in his legs and arms. In this process my car got damaged to an extend of rs 50k plus appr . His Bike also got damaged. The police arrived and tried to take him to hospital but he refused but later he was taken to hospital by his relatives. Both the vehicles were taken to the police post. Now I have made 3 |- 4 rounds of the police station the other party does not come on one pretext or other
The incharge does not release my vehicle until the other party gives in writing. On a little enquire by me from a constable I learnt that the party is seeking money to close the case
In tune of 50K. Do I have to pay because I had bigger vehicle and also because he got hurt and I was safe
Or other wise still I would to pay to get my car release from the court and further go to each and every court hearing. What other remedy do I have. ? Also can I sue Administration for not repairing road since long time.

Sir,
If you think that there was no fault from your side in this incidence, then you need not worry. If the case is pending before the court, then file an application before the court to release your vehicle.
Filing a case against the administration for bad roads is a different aspect altogether.

Sir the car is with the police and the other party is demanding money as I have a bigger vehicle and both police and the MOTER cycle owner are forcing me to pay

Discuss with local lawyer to obtain court orders for taking possession of the vehicle and proceed with the case.
