How to file suit through Power of Attorney

pls provide format

In title of the suit the name of the plaintiff may be in the following manner:

"A son of B, aged about ---- years, resident of --------------------- through his General/Special Power of Attorney X son of Y, resident of -------------"




The introductory para in the body of the plaint may read as under:

1. That the plaintiff is a resident of the aforementioned address. The plaintiff being ill/infirm has constituted, appointed and nominated Mr. X as his General/Special Power of attorney to institute and prosecute the present suit. Mr. X is well conversant with the facts of the case and is in a position to depose about the correctness or otherwise of the facts of the suit. A copy of the GPA (of the original SPA) is being filed along with the plaint."

You need to file an application under Order III Rule 2 CPC seeking the court's permission to represent the plaintiff as an agent.

First you have to get a permission from court by filing the original power of attorney deed in to court and after obtaining the same only you can get along with the suit
