Querist : Anonymous (Querist) 25 November 2011 This query is : Resolved
we four brother and two uncle are having agriculture land in our native place.that has been recently converted into plots by my brother. Now he is asking for power to sell them.in this case what should i do.I want to safe guard my interest because on ricieving the cash he may settle me or not or even delai my share.I want to know when sale occurs can i join there and execute the sale.

If there is such chance then it is better to join in the sale deed and sign it only when you get your due share.
Once you execute POA in his favour there is every chance that he pocket the whole consideration.\ after the transfer.

It shows u do not trust ur brother
U may avoid to sell, issue legal notice that u do not want to sell ur share, can go for partition.

U may ask ur brother to call u as and when required, but do not give POA
Do not give Power
YES u can join there when sale occurs.
be very careful for Survey No. Hissa No, Area of land sold, actual amount, and under the table amount paid, and u r receiving ur share properly or not?
Must not sign or egister Sale Deed w/o receiving Cash / without getting it checked thru ur adv.
