Sir,
We are a registered Resedential Society having two blocks with 60 Flats of two bedroms , three bedrooms , few duplexs and pent house. When the Association was formed five years back the maintainence to be paid for maintaining the common areas such as lawn, motors, electricity etc was decided at Rs. 1500/ . to be paid by all the flats irrespective of two or three bedroom.
However recently there has been a debate by one of the owners that the maintainence should be collected from all flats square feet wise . So the amount will be different for two bedrooms , three bedroom respectively.
Sir, Pls. clarify if there is any law which says it is mandatory for the society to collect the maintainence according to the square feet of each apartment? Or can be the same for all the apartments as decided in the quoram of the annual general meeting of the Society.

In fact use of the common amenities like lawn, electricity, lift etc does not depend much on size of the flat. There is no hard and fast rule on this issue. Basically it is for the members of the society to take decision on the basis of majority.

In many of the societies the maintenance is being collected based on the size of the flats.
But, the decision has to be approved by a resolution in the General Body.

Majority to decide but in my view it should be on the basis of area.
