Querist : Anonymous (Querist) 25 September 2011 This query is : Resolved
My father has 3 brothers. We have 3 properties which have 3 brothers as owners and 2 properties which have all 4 as owners. One brother creates problems while it comes to separation of property.Which is the best solution to go for a separation of property ? Is there any court werein 1 of 4 brothers can file for family separation and court will take the hand over of properties and make a settlement, which will be mandatory for all 4 brothers to abide?

No such court is there, unless you all unanimously agree for to submit to the jurisdiction of a court called LOK ADALAT .

no court can force brothers to abide by settlement . if brothers are desireous of settlement afer filing of suit then as pointed out by mr prabhakar singh you can opt for lok adalat . but if all dont agree to suggestion then case goes back to court

The Civil court would decide case on merit. It is not possible that On filing of case by 1 of 4 brothers and court will immediately take the hand over of properties and make a settlement, which would be mandatory for all 4 brothers to abide.
