Abettment of suicide

Querist : Anonymous (Querist) 18 October 2011 This query is : Resolved
One of my friend is going through severe financial conditions. He has no job on hand and his previous employer has not paid his six months salary which is more than 2 lac. He is having family of four with two kids.
Due to these he may commit suicide.
Can I pressurize his Employer by saying that my friend will commit suicide and he will be the only responsible for that.

Can attempt to commit suicide force his employer to make payment.

You can make a request but force him as threat to commit suicide may vitiate an agreement with coercion.

yes you can ask the employer to pay it, if any evidence on the arrears of salary then file a suit against the employer before labour court

Dear Friend,

If there are problems, it should be sorted out by discussing things and not by blackmailing.

Lodge a specific complain against the employer in details for recovery of dues before the labour commissioner of the State if you do not find out any fruitful result you may file a case in the State High Court under Article 226 of the Constitution of India by taking help from Legal Aid Socaiety.

I go with Shri Biswanath Roy.

You should not try to blackmail the employer in the name of likely suicide by your friend. Adopt the due legal process by making complaint to the Labour Commissioner of the State, and other process as suggested by Mr. Biswanath Roy.

It will be sheer injustice with the employee who have served his employer for more than 5 years with just 5 leave and earned more than 10 folded income for his employer. Now employee is to depend of law and mercy of Employer for his rights.....

If employee will take legal recourse, employer will higher lawyer will consume at least 5 year time.. by that time may be employee off the world or he may tired of attending courts.... there must be some other remedy either legal or illegal....
