Weitage recording to partition registeration & court title to partition said portions

(Querist) 14 November 2011 This query is : Resolved
We are 2 brothers. We want to make partition register for 1.2 acre each of 0.6 & 0.6 acre with clear boundary that we got from registered WILL of Total area of 2.1 acre & probate also not Required in my state.Actualy in my state for partition registeration of non agriculture land,it is 3.5 % each has to spend of appx Rs4.5 lack for partition registeration.Total property value is 2.4 cr i.e Rs 1.2 crore to each other.
If we go through CIVI COURT in manner of entering FAMILY COMPRAMIZE OF ORAL PARTITION for 1.2 acre of land that we got from WILL But simultaneously we ar praying for permanent injuctiton from each other & TO DECLARE AS OWNER FOR SAID PROPORTIONS i.e 0.6 & 0.6 acre ,then each has to spend of Rs 2000(Injuction suit)+60000(Title declaration)+15000(lawyer fee) & Total we have to spend Rs0.77 lack each member(Total Rs 1.54 lak) in which both got oral partition recored ,permanent injuction from each other& TITLE for said proportions.PLZ clarify
1)It is better to go through court OR better to register in sub register office.
2)Is there any problem in future if we go through court for entering oral partition & declaration title for said partition proportion which is cheaper.
3)In ur opinion, which process has more weigtage.
4)With help of above court decree in which oral partition recorded & also declare Title to said proportions whether we can mutuate our name in revenue records with out paying stamp duty & regitering fee furthur.

1. Court process.

2. No.

3. Court.

4. Yes. For family settlement, there is no need of paying stamp duty and even your charges told about court case are at very higher side. No separate fee is to be paid, no declaration of property/title is required.
