Trainee are not the employee

Dear Sir

Pls. provide me the judgment of the supreme court were trainee are not the employee of the organisation & other court also.
Because i was file against a company for recovery of wages u/s 28 of jharkhand shops and establishment act after filig a case i was worked as a trainee in other company the opposite party raised the matter in the court the the complainant was employeed in other organisation after termination so he will not pay for that period.

Why should to expect answer to any unstated fact by you when you did not seem to have revealed the actual problem earlier in your original thread, as you stated in this thread? So far as I recollect, your query was of general nature about trainee as employee. You even tried to open a fresh thread, independent of the previous question, while you could have provided th present information against the same thread.

Even in the present query, you have not stated whether in the new organisation you are on probation on a regular scale or on stipend.

So, don't expect correct solution to your problem with negligible facts or half facts, as experts are not supposed to presume anything. Their answers depend only on the nature of information supplied by the querists.
