Help! regarding copy of succession certificate.

We have a property which belong to my grandfather . The property belongs to my mother and uncle which is undivided /unpartitioned still. My mother wants her share but unable to apply for partition since uncle has seized the property documents (Succession certificates)and is not willing to .

How can we apply for the copy of the these documents so that she can proceed with partition??

Your valuable suggestion would be highly appreciated.

Dear Kavya,

Your mother can seek partition + mandatory injunction seeking production of documents in the court, by filing a suit in the court.

Send a legal notice to ur uncle and demand

the SC and other documents from him as you

need them to file partition suit in court.

obtain copy of succession certificate from the court . if you are aware the year when it was granted , name of parties you cna obtain a copy

Well.. to file partition suit one need not submit tile documents.
Let your uncle dispute the ownership of the properties sought to be partitioned.
For this succession certificate is also not required.

Yes! we are aware of the certificate details like number,year etc,just that we need a copy of it. So should a lawyer be involved or can the copy be obtained through court directly?? How?

What do u mean by mandatory injunction? is Is it stay order? Is'nt that complicated which would cause delay?

mandatory injunction mean directing the defendants to do something or not to do something as of your prayer..

if your uncle built any construction over the undivided property mean direction to demolish it., like that..

my advice to you., just consult your local advocate. and issue legal notice to your uncle by claiming your mother's share.

let them to decide your next move..
