Time frame for chrage sheet

(Querist) 17 July 2012 This query is : Resolved
Kindly advice what is the time limit to file charge sheet after expiry of 90 days from the FIR?

If police deliberately delay to file charge sheet or FRT or FRMS etc. what is the procedure to appeal?

There is no limitation for filing the charge sheet. If the IO is not filing the charge sheet you can file a writ seeking directions to the IO to file the final report.

Investigation is exclusive domain of police and law does not lay down any time limit for that but that does not mean that an investigation can go on perpetually hence in reasonable cases the HIGH COURT CAN PASS suitable orders.

No fixed time frame for it and in case of excessive delay file writ in high court.

You should take benefit of this situation and should apply to the concerned court to exempt your presence on the hearings till the charge-sheet is filed by police. Your presence is just token without any charge-sheet on file.

there is no fixed time limit. however, you can seek the intervention of the high court in case of abnormal delay thru writ
