I have a registered plot in gurgaon th. a co operative group housing society. I've registry of the plot registerd with registrar. I've paid full payments to the society th. cheques. The society is not functioning presently due to elections & the case is pending in the court. Fresh elections are announced but asst. registrar is not considering me as a valid member of the society & my name is not present in the voter list prepared by asst. registrar. Now I want to know can this registration of the plot be cancelled or challanged by new elected members of the society or by any other means i.e asst. registrar or someone else. I've taken the no dues, noc for construction, and zoning plan from the society.

Dear Vijay The registration can be challenged by filing a cancellation suit before the hon'ble court and after all the examination the court have right to cancel the registered documents.

You have not stated the basis of refusal to enlist you as voter.
There might have been a cutof date.
Plot registered in your for consideration paid by you can not be cancelled exparte by the society or the registrar.

Non-existence of your name in the voters list can be due to your being a defaulter of the society. Nature of default, if any would be known either to you or to the management of the society. However, that would not have any effect on your registered plot, unless some dispute is pending in the office of the registrar or in some court against the plot.

You can approach to the Joint District Registrar who is superior to Asst. Registrar for your grievances against this Asst. Registrar , who has turned down your society membership. Or file a case in a Co-operative court against Chairman and Secretary of said society.

I am not a defaulter but yes cutoff date is a issue that too for voting purpose only (as per judgement by Hon court). But Hon court has not given any judgement about cutoff date. Also I want to ask that on what basis the registry can be challanged / cancelled by registrar or Hon court otherwise.
I've spoken to other experts also & as per them, the sale deed / registry is a mutual concent/agreement between two parties and also it can not be challanged or cancelled unilaterly by single party. I am sorry but I do not agree with Mr. Nadeem. Sh.Prabhakar singh ji seems to be correct (as I've understood the case & discussed with other experts) registry can not be challanged / cancelled exparte either by Society or Registrar or someone else.
